Privacy Policy

HealthyYOU Vending, LLC (“HYV”) has created this Privacy Policy in order to demonstrate our firm commitment to privacy. The following discloses our information collection, use and sharing practices for our websites located at healthyyouvending.com, www.healthyvendingatwork.com and www.healthyvending.com (the “Sites”). Please take a moment to carefully review the terms of this Privacy Policy. By using the Sites, you agree to accept the terms of our Privacy Policy. If you do not agree to the terms of our Privacy Policy, please do not use the Sites. This Privacy Policy is in effect no matter the method of collection (such as by mail, sign-up/sign-in page), including collection through our Sites, blog, email lists, and any online features, products, services, and/or programs we offer (collectively, the “Services”).

Personal Information

Information We May Collect

You are not required to provide any Personal Information (as defined below) in order to obtain general access to the Sites. However, in order to access certain information, services or features contained on the Sites, HYV may require you to provide personal information such as your name, email address, mailing address, telephone number, and amount of money you are willing to invest (collectively, “Personal Information”). For information, services or features offered on the Sites for which we require a membership, subscription or other fee or charge, we may also collect certain financial information such as credit card number and shipping and billing addresses, which, if collected, is deemed to be Personal Information.

How We May Use Your Information and Opting Out

If you provide HYV with Personal Information, we may use that information for several purposes. For example, we may use your Personal Information in order to process and fulfill any transactions, services or requests for information that you request.

We may also use Personal Information to ensure compliance with our policies and applicable law.

In addition, we or our selected business partners may send you periodic marketing communications by email or regular mail if you do not opt-out of receiving them. For example, we may provide you with special offers or information on our products or services. If you wish to opt-out of receiving marketing communications from us at any time, we give users the following options for doing so:

  1. Where available, you may indicate that you do not want to receive such mailings at the time you provide your information to us on the Sites;
  2. You may opt-out at any time by sending an email to privacy@healthyyouvending.com with “unsubscribe” in the subject line; or
  3. You may opt-out by clicking on the unsubscribe link in our email newsletters or other commercial email communications.

You may also choose to prevent us from disclosing or using your Personal Information for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization by notifying us by one of the methods at the end of this Privacy Policy or by following the procedures set forth in an electronic communication from us, if applicable. Furthermore, even where your Personal Information is to be disclosed and used in accordance with the stated purposes in this Privacy Policy, you may elect to opt-out of such disclosure to and use by a third party that is not acting as our agent.  There are some uses from which you cannot opt-out, such as using your Personal Information to respond to your requests for information or Services.  Please note that making such opt-out requests does not ensure complete or comprehensive removal of your content. For example, we may retain the information for our own internal records.

Disclosure of Personal Information

We may sometimes use other businesses to perform certain services for us, such as processing orders and delivering our products, sending postal mail and providing marketing assistance and data analysis. We may provide Personal Information to those businesses when that information is necessary for them to complete a requested transaction or otherwise perform their duties on our behalf. We may also disclose Personal Information to selected business partners, such as a franchise consultant, for their use in marketing their services to you, unless you direct us not to disclose your Personal Information to such partners by notifying us.

As HYV develops, we may buy other businesses or their assets or sell our business assets. Customer information is generally one of the business assets involved in such transactions. Thus, in the event that HYV or one of its divisions, or all of their respective assets, are acquired, customer information would be one of the transferred assets. We reserve the right to transfer your Personal Information, as well as any information about or obtained from you, in connection with the merger, sale or other disposition of all or part of our business and/or assets, or in the event of our bankruptcy, reorganization, insolvency, receivership, or an assignment for the benefit of our creditors.

We reserve the right to disclose information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other visitors, or anyone else that could be harmed by such activities. This includes our right to exchange information with other organizations in order to protect against fraud and to reduce credit risk. We also reserve the right to disclose information when we believe in good faith that the law requires it.

We may disclose your Personal Information for any purpose disclosed by us when you provide the information. We may also disclose your Personal Information with your permission or as directed by you.

Other than as stated in this Privacy Policy we do not sell your information to third parties. 

Links to Other Third Party Websites

Certain areas of the Sites may contain hyperlinks to third party websites that take you outside the Sites. These third party websites are beyond our control. They may send their own cookies to visitors, collect data or solicit Personal Information. The privacy policies of these third party websites may be significantly different from our Privacy Policy. We are not responsible for the privacy practices or content of these third party websites and cannot guarantee the security of any of your Personal Information collected there.

Usage Information and Aggregate Information

From time to time, we may collect general, non-personal, statistical information about the use of the Sites, such as how many visitors visit a specific page on the Sites, how long they stay on that page, and which hyperlinks, if any, they “click” on (“Usage Information”). We collect this Usage Information through the use of technologies such as “cookies” and “IP addresses”, which are discussed in greater detail below. We collect this information in order to determine which areas of the Sites are most popular and to enhance the Sites for you and other visitors. We may also group this Usage Information and other information into aggregate visitor data in order to describe the use of the Sites to our existing or potential business partners, sponsors, advertisers or other third parties, or in response to a government request. However, please be assured that this aggregate data will in no way personally identify you or any other visitors to the Sites.

IP Addresses and Cookies

We employ standard technology on our Sites that collects information about how our Sites are used. This information includes the URL that you just came from (whether this URL is on our Sites or not), which URL you next go to (whether this URL is on our Sites or not), what browser you are using, and your IP address (which is a number that’s automatically assigned to your computer whenever you are surfing the web). Many websites automatically collect this information. We use your IP address to help diagnose problems with our server and to administer our Sites. Your IP address is used to help identify you and your shopping cart. We reserve the right to use IP addresses to identify a visitor when we feel it is necessary to enforce compliance with the Sites’ policies or to protect us, our customers, the Sites or others.

Like most websites, our Sites use cookies. Cookies are pieces of information that a website transfers to an individual’s hard drive for record-keeping purposes. In some cases, the cookies are linked to your personally identifiable information.  We use cookies to simplify functions on the Sites for our users. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, please be aware that some features of the Sites may not function properly or may be slower if you refuse cookies. You may occasionally get cookies from our advertisers or other third parties with links on the Sites. We do not control these cookies. The use of advertising cookies sent by third party servers is standard in the Internet industry.

How We Collect Information

We may collect Personal Information and Usage Information about you from the following sources:

  • the correspondence you and others send to us, including when you complete any online forms or send us an email;
  • information we receive from you through the Sites and as a result of your use of our Services;
  • information about your transactions with, or services performed by, us, our affiliates or nonaffiliated third parties;
  • information we receive from your computer or mobile device;
  • information we receive from our affiliates, partners or service providers; and
  • information we receive from other sources, as permitted by applicable laws, rules and regulations.

You may be able to sign up to join our mailing list.  If you sign up, we may from time to time send you an email newsletter or other literature with information about one or more of our Services or with general information about us. You can unsubscribe from our newsletter at any time by the means set forth in that communication.

Data Retention  

We will retain any Personal Information that we collect for as long as we need that information to provide you with our products and services. We will also retain and use your Personal Information as necessary to comply with our legal obligations, comply with our internal business practices and standards, resolve disputes, and enforce our agreements. Personal Information is destroyed when it is no longer necessary for these purposes. Our business partners and third party service providers may have their own data retention policies, and you should review their policies and practices to make sure you understand how long they retain your information.

Persons Under 18 and Children

We do not knowingly collect information from anyone under the age of 18 on our Sites. If you are under the age of 18, please do not provide any Personal Information to us. By visiting our Sites and/or using the Services, you affirm that you are over the age of 13, as THE SERVICES ARE NOT INTENDED FOR CHILDREN UNDER 13 WHO ARE UNACCOMPANIED BY THEIR PARENT(S) OR LEGAL GUARDIAN(S).

Your California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide certain personally identifiable information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain from us (once per calendar year) information about the customer information that we shared (if any) with other businesses for their own direct marketing uses.  If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. To obtain this information, please send an email message to privacy@healthyyouvending.com with “Request for California Privacy Information” in the subject line and in the body of your message.  We will provide the requested information to you at your email address in response.  Please be aware that not all information sharing is covered by the “Shine the Light” requirements, and only information on covered sharing will be included in our response.

California residents who use the Services are entitled to the following consumer rights notice: The Services are owned and/or operated by us. Unless otherwise expressly stated, the Services are provided without charge. If you have a question or complaint regarding the services or products provided through the Services, please send an email to privacy@healthyyouvending.com. “Do Not Track” Signals

Because we may collect your Personal Information from time to time for our own use, we are required to disclose how we respond to “do not track” requests, signals and other similar mechanisms.   Note that your browser settings may allow you to automatically transmit a “do not track” signal to websites and online services that you visit.  Like many websites and online services, we currently do not alter our practices when we receive a “do not track” signal from a visitor’s browser.  To find out more about “do not track,” you may wish to visit www.allaboutdnt.com.

European Union Users

The Sites, the Services and our products are intended for individuals located in the United States, and your use of our products and services are governed by United States law. We are not targeting or marketing to international users. If you are using the Services or our products from outside the United States, please be aware that your Personal Information and Usage Information may be transferred to, stored, and processed in the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By visiting the Sites, using the Services or purchasing our products, you consent to your Personal Information and Usage Information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this Privacy Policy.

We will only process your Personal Information when we have a legal basis to do so. When we do process your Personal Information, we will do so with your consent as set forth in this Privacy Policy, or because the processing is necessary for the performance of the Services or to provide products to you, to comply with our legal obligations, to pursue our legitimate interests, or to establish or defend a legal claim.

Changes to These Terms

The terms of this Privacy Policy may change from time to time. We will notify you of any material changes to this Privacy Policy by changing the “Last Updated” date at the bottom of this Privacy Policy. We encourage you to check this page periodically for any changes. Your continued use of the Sites following the posting of changes to these terms will mean you accept those changes for all previously collected information and information collected from you in the future.

Security

The Sites have security measures in place to protect the loss, misuse and alteration of the information under our control. If you register on our Sites, for example when you use our support service after purchasing equipment, you may be required to create an online account and choose a username and password that will protect your online account information. Access to your online account requires your password. We recommend that you do not disclose your username or password to any other person. In addition, all credit card information is accessed only through secure servers using SSL encryption for the protection of our customers. Credit card information is not stored and is discarded between usages. All databases are secured behind a firewall. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while HYV strives to protect your Personal Information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your Personal Information.

Reviewing and Updating Your Information

If you register for an account on the Sites, you may review and update your account information by sending an email requesting this information to privacy@healthyyouvending.com.
